Prather Ebner partner Dan Ebner, who focuses a portion of his practice on representing trustees and beneficiaries, has written an article for the most recent issue of the Illinois State Bar Association’s Trusts and Estates Newsletter about remote signings of estate planning documents. He makes the point that while the technology for recording the signings of estate planning documents has been available for decades, trusts and estates lawyers have rarely used it. However, the pandemic has prompted recent legislation allowing remote signings for clients who are not venturing out to lawyers’ offices as they once did. This new legislation has brought the issue of recording to the forefront because it requires remote signings to be recorded.
