Attorney Daniel Ebner participated in a mock trial as a member of the Fiduciary Litigation Committee of the American College of Trust and Estate Counsel (ACTEC) during its fall meeting in November 2022.
The mock trial involved a trust reformation proceeding. During this presentation, the Will and Trust Contests Subcommittee explored the elements and factors to be met for reformation of a trust instrument, the applicable standards of proof, and the obligations owed by and to the parties interested in whether the trust should be reformed.
