Lifetime gifting and estate planning are complex topics that can grow even more thorny when family is involved. Prather Ebner Wilson Partner Dan Ebner explored these issues alongside Gail E. Mautner of Seattle’s Lane Powell PC at Cambridge’s Forum on Private Wealth Litigation.
The duo’s April 27 presentation, “Aging of America, Part II: Who the Heck Said ‘Can’t Buy Me Love?’ ” focused on the challenges to lifetime gifting by vulnerable adults of diminishing, or diminished, capacity, as well as pre-death challenges to both lifetime gifting and estate planning.
Dan and Gail explored the topics from the perspective of both an estate planner and a litigator. “Proactive planning for potential challenges is crucial,” Dan says. “We must also consider the strategies and evidence we would be looking for to support or defend litigation to ‘undo’ the gift(s) or planning, either before or after the donor has died.”
