Dan Ebner and Ray Prather shared their expertise during two CLE sessions at the 35th annual RPTE National CLE Conference in Washington, D.C.
Dan’s co-presented session, “Ending on Good Terms: Practical Guidance for Trustees on Termination of Trusts,” focused on empowering a smooth trust exit for trustee clients. Trusts terminate for a variety of reasons:
- A trust could become uneconomical
- The terms of a trust may require all assets to be distributed outright to a beneficiary • The trust may be required to fund subtrusts
- The trustee may be exercising its discretion
Attorneys need to be able to advise their clients throughout the exit process, no matter the cause.
Ray’s co-presented session, “Black Tie Optional: The Eroding Formalities to Creating a Valid Will,” focused on the evolution and related legal roadblocks to modern wills. Wills on cell phones, iPads, and DVDs have been admitted to probate all over the world, and both planners and litigators need to understand the dangers and opportunities of these nontraditional wills.
